If you do not agree with these Terms, you must immediately discontinue use of our website and services.“Affiliates” include companies Link Management Systems, Inc. (“LMS”), Linked Escrow (“Linked Escrow”), First Link Mortgage (“FLM”), and other Link, Inc owned and operated real estate brokerages. “Agents” We work with third-party partners, independent contractors, real estate agents, and brokers. While some Agents may use our branding or marketing materials, they are independent contractors and not employees of Link. These Terms of Service do not govern your interaction with Agents outside of our site. You will be governed but other terms of service, if any, of the websites through which you are interacting with other agents.
THESE TERMS OF SERVICE CONTAIN A MANDATORY ARBITRATION CLAUSE AND CLASS ACTION WAIVER, WHICH AFFECT YOUR LEGAL RIGHTS. PLEASE REFER TO SECTION 15 and 16 FOR MORE INFORMATION.

You represent and warrant that you are at least 18 years of age and legally capable of entering into a binding contract. The services are not available to individuals under 18 years of age, and any use of the services by minors is strictly prohibited.We reserve the right to change our eligibility criteria and refuse access to any person or entity at our sole discretion. You are responsible for ensuring that your use of the services complies with all applicable laws and regulations. If such use conflicts with any laws, access to the services is revoked.Link operates the services from the United States, and we make no representations regarding the availability of the services in other locations. By using the services, you consent to the transfer of your information to the United States, which may have different data protection laws than your country of residence.
3. Services Provided by Link
Link provides real estate brokerage services, including listing properties for sale or rent and facilitating transactions between buyers, sellers, landlords, and tenants. Through our platform, users can submit property listings, search for properties, and connect with Agents. We do not own or control any of the listed properties. Our services also include product and technology development to facilitate real estate transactions.You acknowledge that Link is not responsible for any agreements, interactions, or transactions that occur between users of the services. We strongly recommend conducting your own due diligence before entering any real estate transaction, including verifying property details, performing inspections, and reviewing all legal and financial terms.
4. Registration
To access certain services, you must register for an account (“Account”). You agree to provide accurate and complete information and to keep your Account details updated. You may not select a username that impersonates another person, infringes on the rights of others, or is otherwise offensive, vulgar, or obscene.You are solely responsible for all activities that occur under your Account and for maintaining the confidentiality of your password. You must not use another person’s account or registration information without permission. Notify us immediately of any changes to your eligibility to use the services, any security breaches, or any unauthorized use of your Account.Please note that an account is only required for participating in transactions; you can browse services without creating an Account. You have the option to delete your Account either directly or by requesting us to do so.

In the event of legal action, you agree to submit to the jurisdiction of the courts located in the state of California. Any action must be brought within 1 year after the cause of the action occurred.

This will follow the American Arbitration Association (AAA) rules for consumer disputes, and you waive your right to a jury trial. The Federal Arbitration Act governs this arbitration agreement, not state laws. If the AAA can’t schedule a hearing within 6 months of filing, either party can opt for arbitration through Judicial Arbitration and Mediation Services (JAMS).
16. Class Action Waiver
You agree to not participate in a class action or class-wide arbitration for any claims covered by these Terms. By agreeing to this, you give up your right to be part of a class action against us, including class arbitration or combining claims with others. You also agree not to take part in any claims involving someone else’s account if Link is involved.
17. Severability & Waiver
If any provision of these Terms is found to be invalid or unenforceable, the remainder of the Terms will remain in effect. Failure by Link to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.
18. Entire Agreement
These Terms, along with our Privacy Policy and any other agreements or notices provided by us, constitute the entire agreement between you and Link regarding your use of our website and services, superseding any prior agreements or communications.
19. Force Majeure
Link is not liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, strikes, government actions, or technical failures.
